Terms and Conditions of Carriage

§ 1 Scope of applicability
(a) The terms and conditions of carriage apply to the transportation of people, as well as of animals and goods aboard trains which are the property of the Niederösterreichische Schneebergbahn GmbH – hereinafter referred to as NÖSBB.
(b) NÖSBB staff are responsible for enforcing these terms and conditions.
(c) By boarding a train the passenger recognises the terms and conditions of carriage of the NÖSBB and all other special terms and conditions.

§ 2 Entitlement to carriage
(a) an entitlement to carriage exists when
1. The applicable terms and conditions, the official directives and all other NÖSBB regulations are met
2. Scheduled transportation by train is possible
3. Carriage is not prevented by circumstances for which the NÖSBB cannot be held responsible, and the effects of which it cannot avoid
4. The passenger complies with the standard provisions of carriage.

§ 3 Exclusion of carriage
(a) The following groups of people may be excluded from carriage if they pose a threat to the safe and smooth running of the operation, or to the safety of passengers:
1.
People who are under the influence of alcohol or other intoxicating substances
2. People with infectious diseases which may pose a risk to the health of other passengers or staff
3. People in possession of loaded firearms who are not authorised to bear firearms
4. People whose lack of personal cleanliness poses a nuisance to other passengers, or contaminates vehicles
5. People who do not follow the instructions of operating personnel
(b) In addition, the following people may be excluded from travel:
1.
Unaccompanied children aged five or below
2. Passengers not in possession of a valid ticket, and who refuse to pay the increased fare in accordance with Paragraph 9
3. Passengers who are only able to pay the fare with bank notes of a value which exceeds €100 if the staff are unable to provide change, and if no agreement can be reached on the issuing of a receipt for the change
The decision to deny carriage to passengers is generally made by NÖSBB staff.
People who have been denied carriage in accordance with Paragraph 3 have no entitlement to a refund of the fare.

§ 4 Conduct of passengers
(a) Passengers are obliged to behave in a manner required to ensure the safety and smooth running of the operation, their own safety and with consideration for other people.
(b) Passengers must follow the instructions of the train staff; in particular the conductor and the train driver
(c) Passengers are strictly forbidden from,
1.talking to the driver whilst the vehicle is in motion
2. opening doors before or after designated stops
3. entering or alighting from the vehicle, or standing in the marked door area as the impending departure of the train or closing of the doors is announced
4. throwing or projecting objects out of the vehicle
5. jumping up and down during the tour
6. entering a carriage marked as occupied
7. entering or crossing the rails or tunnels via means other than the designated passageways
8. impeding the usability of the vehicles, in particular aisles and entrances/exits
9. smoking on board vehicles, on the platform in Puchberg/Schneeberg, as well as in the ticket offices in Puchberg/Schneeberg and Hochschneeberg
10. using sound reproduction, radios, television sets or musical instruments on trains.
(d) All passengers are obliged to retain a secure position at all times during the journey.
(e) Parents/chaperones are responsible for the supervision of children.In particular, they must ensure, in the interests of children's safety, that the children do not stand or kneel on the seats, and that they do not run around in the carriages.

§ 5 Carriage of luggage and dogs
(a) The carriage of luggage is allowed in principal, provided that it does not contain any dangerous, illegal or explosive materials.Luggage can be stowed under the seats or in the transport wagon, the “Salamander baby.”Bulky items must be stowed in the “Salamander baby”.Passengers must respect staff instructions in this regard.
(b) In general the fare for dogs is the same as the reduced fare for children aged between 6 and 15. Dogs which are not transported in dog boxes must wear a muzzle and be kept on a lead.Dangerous animals will not be transported.
Muzzles can be hired at the ticket office in return for a deposit.

§ 6 Conduct in the event of unscheduled stops
(a) In the event of an unscheduled stop passengers must wait for announcements to be made by train personnel.Passengers are only permitted to alight from the vehicle if instructed to do so by train personnel.Passengers should be aware that is in the interests of their own safety to remain on board the train.

§7 Delay and cancellation of trains
(a) The delay or cancellation of a train does not entitle ticket holders to compensation.The NÖSBB will endeavour, however, to provide onward transportation to passengers in the event of the cancellation or impeded onward journey of the train.

§ 8 Breaks in the journey
(a) Breaks may be made to the journey as often as required within the validity period of the ticket; however, the validity period is not extended as a result.Breaks to the journey can be made known to staff prior to the commencement of the journey, or by pressing the request stop button on the train.
(b) By breaking the journey the passenger recognises that they may not be guaranteed a seat when rejoining the train for the remainder of the journey.

§ 9 Tickets and fares
(a) The NÖSBB provides proof of every payment it receives.Tickets are valid as invoices in accordance with the VAT Act.
(b) The tariff includes the fare.The tariff is held by the NÖSBB for inspection.If fares are charged incorrectly then the difference must be paid later.This can be made to the conductor directly during the ticket inspection on the train.

§ 10 Refunds
(a) The Niederösterreichische Schneebergbahn will refund fares free of charge if the tour does not take place for reasons for which the NÖSBB can be held accountable.
(b) The Niederösterreichische Schneebergbahn refunds all tickets booked in advance for a fee of 10% of the refund amount if the refund is claimed, in person or in writing, more than 24 hours prior to the scheduled departure time.
(c) All tickets booked in advance can be changed once, free of charge, to a later travel date.Changes are possible up to 3 days prior to the scheduled travel date/time if the NÖSBB is informed by telephone or in writing in good time.Tickets can be changed up to one hour before the scheduled departure time at the ticket counter at Puchberg am Schneeberg station.
(d) For group bookings, school and youth groups the regulations concerning refunds and changes are those which were agreed upon when the contract of carriage was concluded.These regulations form part of the NÖSBB reservation regulations.
Furthermore, the tariffs concerning the carriage of people and luggage, as well as the NÖ Schneebergbahn GmbH reservation regulations shall apply, and can be viewed at any time.
